Attorney Bio

Kathy L. Kottos is senior counsel in the complex litigation/dispute resolution group. Kathy focuses her practice on prosecuting and defending a wide variety of disputes at the trial and appellate stages, including complex commercial disputes, construction litigation, health care liability claims, employment disputes, and administrative claims.

Kathy’s practice includes successfully conducting multiple complex investigations on behalf of major insurance carriers to identify healthcare fraud schemes and violations of federal and state licensing, anti-kickback, and self-referral laws. Her experience includes the prosecution of multiple multi-million dollar civil fraud and RICO cases against healthcare providers on behalf of major insurance carriers in connection with the fraudulent submission of claims in violation of licensing and other laws and regulations, serving as lead counsel in all phases of discovery, litigation, and dispute resolution.

Kathy received her J.D. from John Marshall Law School, receiving Order of the Coif distinction and serving as lead articles editor for the John Marshall Law Review. Prior to law school, she earned her B.A. in economics, graduating with honors, from DePaul University.

Representative Experience

  • Conducted multiple complex investigations on behalf of major insurance carriers to identify healthcare fraud schemes and violations of federal and state licensing, anti-kickback, and self-referral laws;
  • Prosecuted multiple multi-million dollar civil fraud and RICO cases against healthcare providers on behalf of major insurance carriers in connection with the fraudulent submission of claims in violation of federal and state licensing, anti-kickback, and self-referral laws. Served as lead counsel in all phases of discovery, litigation and dispute resolution;
  • Conducted multiple complex investigations on behalf of national insurance carriers to identify healthcare fraud schemes and violations of federal and state licensing, anti-kickback, and self-referral laws. Served as lead counsel in all phases of discovery, litigation and dispute resolution;
  • Defended major healthcare providers, device manufacturers, and pharmaceutical companies in federal and state healthcare fraud investigations and litigation, including for alleged violations of the Anti-Kickback Statute and Stark Law, and under the Hatch-Waxman Act;
  • Defended individuals and entities in actions relating to violations of the federal mail, wire, and tax fraud statutes;
  • Conducted multiple key witness interviews of client executives and made presentations to the United States Department of Justice.
