Munck Wilson Mandala’s litigation team once again won on behalf of client Valtech. MWM defended Valtech in a dispute brought by Cornerstone, which alleged that Valtech fraudulently induced Cornerstone into an asset purchase agreement. Cornerstone alleged that Valtech misrepresented that it would be exiting the staffing industry and failed to disclose staffing contracts it retained after the asset sale.

Earlier this summer in the first trial, MWM represented Valtech as plaintiff in a dispute against Cornerstone over an earn out payment due under an asset purchase agreement. Cornerstone refused to pay and countersued Valtech for fraud, breach of contract and breach of fiduciary duty. MWM’s Michael McCabe gave a great cross-examination of Cornerstone’s corporate representative and Valtech was awarded $1.2 million plus attorney fees.

In this second trial of the same case, the jury returned its verdict in an hour on Aug. 30, 2018, determining that Valtech did not defraud Cornerstone or conceal information from it.
