Jenny Martinez is a member of MWM’s executive committee and she co-chairs the litigation group. Jenny represents both plaintiffs and defendants in business disputes involving trade secrets, intellectual property, employment disputes, contracts, and collections. She works alongside MWM’s patent, copyright, privacy, data protection, employment, antitrust, and trademark lawyers to provide clients with extremely specialized advice in new tech development.

Jenny was a key member of the legal team defending Halliburton in connection with all civil litigation and investigations arising out of BP’s Macondo well (Deepwater Horizon) blowout in the Gulf of Mexico — the largest environmental lawsuit in the history of the United States. She is annually listed among the Lawdragon 500 Leading Lawyers in America, Texas Super Lawyers, and Best Lawyers in America.

Representative Matters

  • Representing international pharmaceutical company in complex lawsuit asserting claims for patent infringement, breach of contract, misappropriation of trade secrets, trade dress infringement, and unfair competition. The case has involved two separate cases filed in California and Texas against over 20 defendants. Obtained dismissal of several key causes of action based on personal jurisdiction, preemption, and other grounds under FRCP 12(b(6) and repeatedly obtained favorable discovery rulings that have put the case in a strong position to obtain summary judgment in the coming months. The plaintiff seeks over $200 million and is set for trial in November 2023;
  • Represented Halliburton in all civil investigations and litigation arising out of BP’s Macondo well blowout (Deepwater Horizon) in the Gulf of Mexico;
  • Represented financial institutions in litigation involving breach of promissory notes, breach of guaranty agreements, fraud investigations and recoveries under financial institution bonds;
  • Represented financial institution in arbitration involving software developer’s breach of contract to develop and customize loan origination software;
  • Represented international manufacturing and technology company in class action litigation involving allegations of breach of warranty and consumer fraud;
  • Represented international life insurance and pension company in class action litigation involving allegations of consumer fraud.
