Munck Wilson Mandala, LLP is seeking an employment law associate attorney to join the firm’s growing Los Angeles office located in Century City. The ideal candidate will have a minimum of 3 years of California employment law experience in a mid to large size law firm, with exposure to both litigation and advice and counsel. This position is primarily in office with flexibility to work remotely as appropriate based on assignments and business needs.

Primary Responsibilities

  • Defense of discrimination, harassment, retaliation, whistleblower, wrongful termination, and failure to accommodate claims
  • Defense of claims for alleged violations of California’s Labor Code and Wage Orders, including based on obligations to pay minimum wage/overtime, to provide meal and rest breaks, and to make prompt payment of wages
  • Counsel employers on a wide variety of issues with respect to employment policies and decision-making
  • Interview witnesses and oversee fact-gathering for case development
  • Evaluate claims and defenses to develop recommendations for case strategy
  • Draft motions, pleadings, position statements, and mediation briefs
  • Prepare and respond to discovery requests and meet/confer letters
  • Take and defend depositions
  • Appear for court hearings/conferences, and ADR proceedings (mediation/arbitration)
  • Respond to demand letters and requests for disclosure of employment records
  • Negotiate with opposing counsel to resolve discovery disputes, facilitate settlements, etc.
  • Investigate claims of workplace misconduct and prepare report of findings

Minimum Qualifications

  • Juris Doctorate from an ABA accredited law school
  • Active license to practice law in the State of California
  • In good standing with the State Bar of California
  • Admitted to practice before the United States District Courts for the Central, Eastern, Northern, and Southern Districts of California (or will seek such admission promptly)
  • At least three years of experience defending litigation in California (in both state and federal court), including:
    • preparing and responding to pleadings
    • preparing and responding to discovery
    • drafting motions, supporting papers, and other submissions to courts
    • conducting meet/confers regarding discovery disputes
    • appearing in court for case management conferences, motion practice
  • At least three years of experience representing employers on employment law matters
  • Excellent research, writing, communication, and interpersonal skills
  • Strong analytical and problem-solving abilities
  • Ability to work independently and as part of a team
  • High level of professionalism and ethical standards
  • Ability to handle multiple tasks, projects, and deadlines simultaneously
  • Commitment to continuous learning about applicable employment laws
  • Ability to appear on behalf of clients in court, arbitration/mediation, and agency proceedings
  • Ability to travel as required for client matters (inside and outside California)

Preferred Experience

  • Defense of class actions and PAGA claims
  • Investigation of workplace complaints
  • Familiarity with and participation in arbitration and mediation proceedings
  • Preparation/review of employee handbooks and employers’ standalone workplace policies
  • Experience responding to (and counseling employers regarding) requests for disclosure of employment records
  • Preparation of position statements in connection with agency investigations/charges
  • Appearances in connection with administrative wage claims

The expected salary range for this position is $175,000 – $250,000. The salary range for this position applies to associate attorneys licensed in California and based in the firm’s Los Angeles office. Actual compensation will be determined based on experience and other factors, as permitted by law. Relevant factors include (without limitation) an individual’s experience, education, licensure and/or certifications, geographic location, market demands, and business and organizational needs.
