Daniel Withers is a senior associate in the firm’s litigation practice. He represents clients across a wide range of intellectual property matters, from complex litigation to strategic transactional work. His practice includes representing generic drug companies in Hatch-Waxman litigation and advising businesses on intellectual property issues that arise in mergers, acquisitions, and commercial transactions.

Leveraging his background in biomedical engineering, Daniel handles technically demanding disputes involving pharmaceuticals and other advanced technologies. He has represented drug companies in infringement litigation arising from their filing of Abbreviated New Drug Applications, defended and enforced trademark and trade dress rights for international fashion companies, and represented trademark owners in opposition proceedings before the Trademark Trial and Appeal Board. He also works with clients before disputes escalate, assisting with pre-litigation enforcement strategies and responding to infringement allegations.

On the transactional side, Daniel conducts intellectual property and data privacy due diligence in mergers and acquisitions, drafts licensing and software development agreements, advises on open-source license compliance, and counsels clients on intellectual property security agreements. His practice focuses on helping clients both protect and maximize the value of their innovations.

Daniel earned his JD from Texas A&M University School of Law, an MS in biomedical engineering from the University of Texas at Dallas, and his BS in biology and Spanish from Southwestern University. Daniel is also fluent in Spanish.
