In today’s fast-paced and competitive business environment, safeguarding intellectual property is critical. MWM has a proven track record in trade secret litigation and related legal disputes involving a wide range of business and technical information in state and federal courts. Our trade secrets practice encompasses proactive protection and aggressive enforcement or defense.
Proactive Trade Secret Protection MWM helps clients identify and fix gaps in the protection of their trade secrets and proprietary information. We recommend and implement cost-effective strategies to safeguard trade secrets and proprietary information through internal policies, training practices, and agreements with employees, independent contractors, and actual or potential business partners. If your competitive advantage resides in your proprietary algorithms, platform architecture, customer data insights, and workforce analytics capabilities, it’s essential to take affirmative steps to protect your trade secrets and proprietary information.
Aggressive Enforcement MWM helps clients relentlessly pursue those who misappropriate trade secrets, improperly solicit or hire employees, interfere with contracts or business relations, and otherwise engage in unfair competition. Our team has the knowledge, skill, and resources to quickly and aggressively pursue those who misappropriate trade secrets and confidential information or otherwise unfairly compete, including seeking temporary restraining orders and injunctive relief.
White Hat Defense MWM is equally aggressive in defending clients against allegations of trade secret misappropriation, violations of contractual and fiduciary duties, employee raiding, and other types of unfair competition. Our team understands the impact that these allegations can have and prioritizes efficiency and credibility.
Technological Expertise Because MWM has extensive experience with technical matters, we are uniquely qualified to understand and explain to the judge and jury the complex technical issues often involved in trade secret litigation and other sophisticated IP litigation matters.

MWM represented ams Sensors USA in a trade secret and breach of contract lawsuit involving cutting-edge light sensor technology installed in smart phones and similar devices. Issues included the existence of a trade secret, misappropriation and use, calculation of the head-start period resulting from theft of trade secrets, damages from use of trade secrets, and inevitable disclosure. The MWM team secured a $50 million-plus judgment at trial and appeal.
WorldVue Connect Global, LLC v. Szuch Holdings, LLC, 155 F.4th 472 (5th Cir. 2025). MWM secured a preliminary injunction enforcing WorldVue’s confidentiality and noncompete agreements against a former-executive-turned-competitor and successfully defended that result on appeal. MWM then secured summary judgment for WorldVue on all claims and a permanent injunction precluding the competitor from using WorldVue’s confidential information.

In this dispute involving allegations that defendants misused information shared during due diligence, MWM secured a summary judgment on all claims and damages, knocking out a $200 million damages model and avoiding trial.
Sun Mechanical Contracting v. TDIndustries, Inc., No. C20213455 (Ariz.). Less than two weeks before trial was set to begin and with a pending motion to exclude Sun Mechanical’s expert under advisement, the parties entered a walk-away settlement.
By: Wallace Dunwoody and Michele Himstedt The Response Deadline Is Now Triggered by the Filing of the Motion, Not the Hearing Date For most practitioners, this will likely be the most consequential day-to-day change. Under the prior Rule 166a, deadlines were anchored to the hearing date—the motion was due 21 days before the hearing, and
